The New York Attorney General’s Office of Special Investigation has opened an investigation into the death of a pedestrian following a motor vehicle collision involving an off-duty Westchester County Department of Correction officer in Cornwall, Orange County. The pedestrian was struck on August 31, 2026, and died from his injuries at a local hospital on September 5, 2026.
Shortly before 10:30 p.m. on August 31, the off-duty officer was driving on State Route 32 in Cornwall. As the officer turned right onto Quaker Avenue, the vehicle struck the pedestrian, who was then transported to the hospital.
Under New York State Executive Law Section 70-b, OSI assesses every reported incident in which a police officer or peace officer, including a corrections officer, may have caused a person’s death through an act or omission. The law applies whether the officer was on duty or off duty, whether the person who died was armed or unarmed, and whether that person was in custody or incarcerated.
If OSI’s assessment indicates that an officer may have caused the death, the office proceeds with a full investigation of the incident. The Attorney General’s office said the facts released about the Cornwall collision are preliminary and subject to change.
